We were pleased to host Dr. Clemens Danda from the Robotics & AI Law Society (Berlin) for a seminar on Product Liability for Artificial Intelligence, chaired by CDL Senior Research Associate Jane Loo and CDL PhD Candidate Huijuan Peng.
Dr. Danda discussed how the new EU Product Liability Directive extends to AI, while highlighting key gaps that remain unresolved. He illustrated how liability considerations differ across AI domains — from Embodied AI (robotics and physical safety risks) and Agentic AI (automated workflows and economic loss) to Generative AI (harmful content) and LLMs as companions (psychological harm).
These sector-specific distinctions raise an important question: can we meaningfully define common principles for AI product liability? Exploring these differences also provides opportunities to engage with emerging concepts in the Directive, such as liability for data loss and digital services.
